Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Prysm mobile application and website (the "Service") operated by Prysm App Inc. ("we," "us," or "our"), a limited liability company registered in Arizona, USA.

By creating an account or using Prysm, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 18 years old to use Prysm
• You must provide a valid phone number for verification
• You must not have been previously banned from Prysm
• You must not be a registered sex offender
• You are limited to one account per person

2. Your Account

You are responsible for maintaining the security of your account and all activity that occurs under it. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account information up to date
• Use only your own photos that accurately represent your current appearance
• Not share your account with anyone else
• Notify us immediately if you suspect unauthorized access to your account

3. Community Guidelines

By using Prysm, you agree to treat all users with respect and dignity. The following are strictly prohibited:

• Harassment, bullying, intimidation, or threats of any kind
• Hate speech based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Sharing sexually explicit content or unsolicited sexual messages
• Impersonating another person or using fake photos
• Spamming, soliciting, or promoting products or services
• Attempting to scam, defraud, or manipulate other users
• Sharing other users’ personal information without their consent
• Creating multiple accounts or fake accounts
• Using the Service for any illegal purpose
• Circumventing any safety or security features of the Service

4. The 3-Strike Safety System

Prysm enforces a strict 3-strike policy to maintain a safe community:

• Strike 1 — Warning: You receive an in-app notification explaining the violation and the specific community guideline that was broken
• Strike 2 — Suspension: Your account is temporarily frozen for a set period. A countdown timer shows when your account will be reactivated
• Strike 3 — Permanent Ban: Your account is permanently removed from Prysm. You may submit an appeal within 30 days, which will be reviewed within 5 business days

Severe violations (threats of violence, sharing of intimate images without consent, or involvement of minors) may result in an immediate permanent ban without prior strikes.

5. Subscriptions and Payments

5.1 Subscription Tiers

Prysm offers three subscription tiers:

• Spark (Free): Includes unlimited messaging, basic filters, daily questions, and interest callouts
• Flow ($9.99/month or $95.99/year): Includes all Spark features plus advanced filters, read receipts, Flow Analytics, Second Chance, compatibility percentages, and no ads
• Momentum ($19.99/month or $179.99/year): Includes all Flow features plus Ghost Mode, Top Picks, monthly boosts, typing indicators, enhanced visibility, dark titanium UI, and priority support

5.2 In-App Purchases

The following are available as one-time or pack purchases on all tiers:

• Boost ($1.99) — 2-hour 10x visibility
• Super Connect ($1.99) — Priority notification to a specific user
• Streak Freeze ($0.99) — Protect your daily question streak
• Spotlight ($4.99) — Top of the discovery feed

5.3 Billing

Subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you agree to their respective terms of service. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your device’s app store settings.

5.4 Refunds

Refund requests are handled by Apple or Google in accordance with their refund policies. We do not process refunds directly.

6. Referral Program

Prysm may offer referral programs from time to time. When a referral program is active:

• Each referral code is unique and single-use
• Referral codes must be entered during onboarding and cannot be applied after account creation
• A user may only use one referral code ever
• Referral rewards are promotional entitlements with no cash value and are non-transferable
• Creating fake accounts to earn referral rewards constitutes fraud and will result in revocation of all rewards and potential account ban
• By entering a referral code, you consent to your first name being visible to the person who referred you for referral tracking purposes
• Prysm reserves the right to modify, suspend, or terminate any referral program at any time without notice

7. User Content

You retain ownership of the content you create and upload to Prysm (photos, bio, messages). However, by using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing and improving the Service.

You represent that you have the right to upload all content you submit and that it does not violate any third party’s rights.

We reserve the right to remove any content that violates these Terms or our Community Guidelines.

8. Intellectual Property

The Prysm name, logo, design, and all related trademarks, service marks, and trade dress are the property of Prysm App Inc.. You may not use, copy, or distribute our intellectual property without our express written permission.

9. Phone Verification and Account Security

Prysm requires phone verification to prevent fake accounts and maintain platform integrity. Each phone number may only be associated with one active account. Device identifiers and IP addresses may be used to detect and prevent multi-accounting.

10. Account Deletion

You may delete your account at any time through the Settings screen in the app. Upon deletion:

• All your personal data, profile content, matches, and messages are permanently removed
• Any active subscription continues until the end of the current billing period (manage through your app store)
• Any pending referral rewards are forfeited
• Your phone number and email are held in a hashed format for 6 months to prevent abuse
• You must wait 6 months after voluntary deletion before being considered a new user eligible for referral codes

11. Limitation of Liability

To the maximum extent permitted by law, Prysm App Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:

• Any interactions or relationships formed through the Service
• Loss of data, revenue, or profits
• Service interruptions or technical failures
• Actions of other users

Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

12. Disclaimer of Warranties

Prysm is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

We do not conduct criminal background checks on users. We are not responsible for verifying the accuracy of information provided by users.

13. Indemnification

You agree to indemnify and hold harmless Prysm App Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Arizona, USA, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Maricopa County, Arizona.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or by email. Your continued use of Prysm after changes are posted constitutes your acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
